Terms and Conditions:
Buyers Premium and Sales Tax: The Buyer's Premium of 10% will be added to each successful bid. No sales tax will be charged since this is a liquidation of the farm.
Payment: Cash, Wire Transfer, Credit Card (5% Card Fee Applies) or Good Check are approved methods of payment. There is a $50 fee for returned checks. Non payment will be turned over to the Botetourt County Sheriff's Dept. Payment must be made in full before items are removed from the auction site and ALL PAYMENTS ARE DUE BY 1:00PM ON June 10th, 2023 OR YOUR CARD WILL BE CHARGED FOR YOUR PURCHASES. If payment has not been made by the end of the pickup period credit cards will be charged for the full invoice amount. Titles (if applicable) will be held until checks clear.
Pickup: All winning bidders will need to sign up for a pick-up time, the link will be attached to your emailed invoice after the auction is complete. Pick-up is Saturday, June 10th from 9:00AM to 1:00PM. Please do not bid if you cannot pick up your items on this day. Everything must be removed by 1:00 on June 10th, NO EXCEPTIONS.
Merchandise: All Items Are Sold AS IS, WHERE IS, WITHOUT GUARANTEE. We urge you to examine all items carefully and satisfy yourself as to the condition and bid accordingly. All of the cows have been vet checked and confirmed bred as of April 15th 2023; the owners nor the auction company make any guarantees of any circumstances after that date that could affect the pregnancy or birth of a live calf. The cattle were weighed on the farm scales which have not been certified. Titles (if applicable) are guaranteed for all titled vehicles unless the description states "no title". If paying by check, titles may be held until check clears.
Condition details are offered as courtesy to bidders, and are opinions only, not statements of fact, and do not imply any warranty concerning condition, or any assumption of liability. Lot announcements, listings, photographs, and catalog information are for descriptive purposes only.
Bidding: The highest bidder for each item shall be the buyer, and if any dispute arises as to any bidding, or between two or more bidders, the auctioneer will have sole discretion to determine the successful bidder, or the disputed lot shall be offered again at the last undisputed bid and resold. The auction record kept by Auctioneer and Clerk is final.
Owner or Owner's Agent may not bid on his/her own items.
Liability: View and bid at your own risk. Allied Auctioneers, nor their employees, agents, helpers are not responsible for injury or damage of any kind, to anything or anyone, while previewing, bidding, loading out, or conducting business. By placing a bid, you agree to hold Allied Auctioneers & Associates LLC., and their agents harmless regardless of opinion.
Auctioneers Announcement: The auctioneer reserves the right to accept bids on behalf of an absentee bidder, the seller, or himself. The auctioneer reserves the right to accept or reject any bid and in all cases of dispute the auctioneer’s decision shall be final. By registering to bid on this auction you will be added to our email list and will receive future marketing. You will have the option to remove yourself from this list if you so choose.
Technical Issues: Neither the company providing the software nor the auction company shall be held responsible for a missed bid or the failure of the software to function properly for any reason. In the unfortunate event of a DDOS attack or server attack/shut down, the auction company reserves the right, but is not required, to extend bidding time. To minimize the chance of being affected by internet or software issues, please use the “Max Bid” feature.
